Visit www.chicos.com anytime between May 1, 2009 and May 31, 2009, click on the Mother’s Day Sweepstakes link, and complete and submit the online registration. Alternatively, you may enter by visiting a participating Chico’s retail location anytime during normal business hours between May 1, 2009 and May 31, 2009, completing an official entry form, and depositing it in the entry box provided. Entries are limited to one (1) per person, per day, per each entry method. Photocopied, mechanically-reproduced, forged, or altered entries and facsimiles are void. Incomplete or illegible entries are not eligible. Entering invalid personal information will result in sweepstakes disqualification. All entries become the property of the Sponsor and will not be returned. Online entries must be submitted and received by 11:59 PM ET May 31, 2009. In-store entries must be received by the close of business on May 31, 2009.2. Drawing: Grand Prize winner will be selected via random drawing, on or about June 15, 2009 in Marblehead, MA, from among all eligible entries received. Drawing will be conducted by PROMOSIS, INC., an independent judging organization whose decisions in all matters relating to this promotion are final. The potential Grand Prize winner will be contacted by Promosis via US mail or express courier (certified mail if resident of Puerto Rico). The Grand prize winner, after eligibility verification by Promosis, will choose the five friends who will be sharing in the prize and distribute the First Place Prize winner paperwork to them. All potential winners will be required to complete and have notarized an Affidavit of Eligibility and liability/publicity release that must be returned and received within 14 days of the date mailed to potential Grand Prize winner (30 days from receipt of notification, if potential winner is a resident of Puerto Rico), or prize will be forfeited. If potential winner is a minor in his/her jurisdiction of residency between 18 and 21 years of age, the prize will be awarded in the name of the parent/legal guardian, pending timely completion and return of Affidavit by parent/legal guardian as stated herein.
3. Prizes: One Prize: A $10,000 Chico’s shopping spree with consultation and assistance from Sher Canada, plus limo service to and from the shopping spree, valued at $300. The Grand Prize value will be divided equally among the Grand Prize winner and her five (5) selected friends (First Place Prize winners); Grand Prize winner and selected friends will each be awarded $1,666.66 to spend in the shopping spree. Each winner will have the option of choosing to receive the prize as a $1,266.66 Chico’s shopping spree plus $400 cash to help with taxes. Shopping spree prizes will be awarded as a single, one-time, personal shopping spree for the winner and five selected friends at the Chico’s boutique nearest the Grand Prize winner’s home, hosted by Chico’s Stores Senior Vice President and top style expert, Sher Canada. Transportation via limo from the Grand Prize winner’s home to and from the shopping spree will be provided for the winners. Approximate retail value of each Prize is $1,716.66. The shopping spree will be scheduled between Sponsor and Grand Prize winner at a mutually-agreed upon date and time, and is subject to scheduling availability and certain other restrictions. Shopping spree portion of prizes are redeemable for Chico’s apparel and accessories available in the store during the scheduled shopping spree, only. Any unused portion of the winners’ shopping spree value will not be awarded. No substitution, cash redemption, cash alternative (except as specified above), or assignment or transfer of the prizes is permitted, in whole or in part. If the Grand Prize winner declines the Prize, fails to claim the Prize, is unavailable for Prize fulfillment, or fails to abide by these Official Rules, Sponsor may select an alternate winner from all remaining eligible entries. Winners are solely responsible for all applicable federal, state, or local taxes on the value of their prizes, and will be issued an IRS 1099-MISC tax form for the retail value of prize won. Winners are responsible for all costs or expenses related to the acceptance or use of the prize not specifically exempted herein. In no event will more than stated number of prizes be awarded. By accepting a prize, winner agrees to the release of his or her name and/or likeness for potential publicity purposes, where permitted by law. Odds of winning are dependent upon the number of eligible entries received.
4. Eligibility: Sweepstakes is open only to legal residents of the 50 United States and Washington DC (including Puerto Rico) who are at least eighteen (18) years of age at the time of entry. Not open to employees of Chico’s FAS, Inc., its subsidiaries, respective affiliates, prize supplier, advertising and public relations agencies, PROMOSIS, Inc., and their immediate families as well as individuals living in the same households of such employees. Entrants agree to the release of their name, address, and email information to Promosis for winner notification purposes and for public winner disclosure as required by law, only. By entering the Sweepstakes, you agree to be bound by Chico’s privacy policy located at privacy policy. Sweepstakes is void where prohibited, and is subject to all applicable Federal, State, and local laws and regulations. By entering, participants agree to be bound by these official rules.
5. Limitation of Liability: Sponsor and its promotion partners are not responsible for printing or typographical errors in any sweepstakes-related materials; or for any individual's inability to enter the sweepstakes, including but not limited to unavailable network, server, or other connections; failed software or hardware transmissions; other errors of any kind, whether human, mechanical, or electronic, including lost, late, incomplete, damaged, or misdirected entries; or for any damage to any computer related to or resulting from participation. Multiple entries beyond what is specified in section 1, and those that are generated by script, macro, or other automated entry devices are not valid, and will be disqualified. Entries that are tampered-with, forged, illegible, mutilated, altered, mechanically duplicated, or obtained through unauthorized distribution channels are not valid and will be disqualified. Sponsor reserves the right to cancel or modify the promotion should any of the foregoing occurrences corrupt or impair the administration, security, fairness, or proper play of the promotion, as determined by Sponsor in its sole discretion. If the promotion is cancelled for any reason listed above, Grand Prize winner will be determined via random drawing from all eligible entries received up to the time of promotion cancellation. Entrants agree that the Sponsor, its promotion partners, related companies, and agencies, and their respective employees or officers shall not be liable for injury, losses, damages, or costs of any kind resulting from participation in this promotion or acceptance of or use or misuse of a prize or parts thereof.
6. Dispute Resolution: THIS PROMOTION IS GOVERNED BY THE LAWS OF THE UNITED STATES AND THE COMMONWEALTH OF MASSACHUSETTS, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this promotion, participant agrees that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or connected with this promotion, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Massachusetts having jurisdiction. Further, in any such dispute, under no circumstances will participant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental, or consequential damages, including reasonable attorneys' fees, other than participant’s actual out-of-pocket expenses (i.e. costs associated with entering this promotion), and participant further waives all rights to have damages multiplied or increased.
